Court rules for plaintiff in transgender discrimination suit
24th September 2008
A federal judge has ruled the Library of Congress discriminated against a Virginia woman when it revoked a job offer after learning she was making the transition from being a man to being a woman.
The American Civil Liberties Union filed the lawsuit in 2005 on behalf of 52-year-old Diane Schroer of Alexandria. Schroer is a former Army Special Forces commander who applied about four years ago for a job as a terrorism research analyst.
U.S. District Judge James Robertson concluded Friday that Library of Congress officials did not have a legitimate reason to deny Schroer the post. He says their move violated the Civil Rights Act’s ban against sex discrimination.
In a statement released by the ACLU, Schroer says it was "gratifying" the court ruled discrimination against a person transitioning genders is illegal.
